A Detailed Study And Analysis With Judicial Precedents On The Interpretation Of Section 173(8) Of Code Of Criminal Procedure, 1973

ABSTRACT


Section 173(8) of the Code of Criminal Procedure deals with an elaborated and proper descriptive process of investigation touching all the minute and precise details necessary for the point of ensuring proper justice to the citizens of India. This is the most crucial legislation in the investigation segment of law that aids in smooth conduct of process and comes under the Chapter 12 of CrPC, 1973 The information to Police and its powers to investigate. This specific section prescribes the laws to be followed while preparation of report by a police officer on completion of investigation containing a total of 8 clauses whereby the 8th clause regarding the conduct of further investigation has been interpreted and discussed in detail mentioning all the codes to be followed during the process, explaining how to follow the process, its evolution past these years in judiciary, the extent of scope and the use, applicability of the section, how it fulfils the pleas of complainant and safeguards the accused’s rights over the magistrate’s authority within the court’s powers to interpret this clause along with relevant judicial precedents and its interpretation with respect to this clause with all the circumstance when it can be conducted as well as the challenges it faces during its implementation enclosing its limitations and discussing the future prospectives it holds for safeguarding justice. The objective of this article is to elongate this specific clause of section holding utter importance in the procedural aspect in any case. Here the author has interpreted each and every detail of the clause and all its potential angles of usage in legal field in a positive way to uphold justice in the country. The primary data referred here includes various articles by advocates, all the case laws’ judgements come up as the secondary data source for fuelling this research article.
