A Critical Study On E-Contracts With Specific Reference To Jurisdiction And Legal Challenges

ABSTRACT

E-contract is an essential part of E-commerce, and it is legally recognised by law. The provisions of the-contract Act, 1872, and Information Technology Act, 2000 give statutory recognition to the E-contract. The various provisions of the Indian Evidence Act, 1872 makes the E-contract enforceable. Since E-contract is a virtual contract, it can be created from any place in the world, this creates question regarding Jurisdiction. This paper analysis the element of E-contracts, jurisdiction and legal challenges faced by E-contract.
