A Critical Study Of Feminist Judging

ABSTRACT

The significance of gender and other intersecting identities in the law is emphasized by the feminist judging framework for legal analysis. It rejects the traditional conception of law as a discipline that is neutral and objective and emphasizes the ways in which it both reflects and legitimizes the systems of social power. In order to practice feminist judging, one must engage with legal materials in a manner that emphasizes the perspectives and experiences of marginalized groups and takes into account the larger social context in which legal disputes are raised. Feminist judging allows judges to advance justice and equity while also helping to continue the continuous struggle to end systemic inequality.
