A Critical Approach To Fundamental Validity Of Media Trials

ABSTRACT


“The problem with the electronic media is all about TRPs, leading to more and more sensationalism, damage reputation of people and masquerade as form of right.” - Supreme Court of India


This article critically focuses on the determining the constitutional validity of media trials as a whole. The author has used several precedents and contemporary cases to lay out a design as to how media trials have been violating the fundamental rights of citizens. The article further focuses to critically analyze the nuances of media trials as well as how efficient they are in helping with achieving justice. The prime aim of author behind this article is to very efficiently and effectively analyze the media trials, whether a boon or a bane for the citizens of India. The article also focusses on analyzing the contemporary status of media trials in India and their unintentional impact of media trials on the conscience of Judges. The article also enunciates figuratively the merits and demerits of media trials per se and as to whether the media trials violate the fundamental rights of those on trial. The article lays a vast critical analysis of media trials and their stand in this modern world as to how much of an influential effect they can have on the common people as well as the judiciary and the complete trial and decision- making process.
