A Critical Analysis Of The Legal Framework Of Live-In Relationships In India

ABSTRACT


The notion of live-in relationships is relatively new but not entirely alien in Indian context. None of the statutes dealing with marriage recognize “live- in” relationship directly. The five-decade old live-in relationship case has been attempted to be brought under the jurisdiction of marriage by the Supreme Court. The Protection of Women from Domestic Violence Act of 2005 also clearly mentions the phrase “relationship in the nature of marriage”. The paper focuses on critically analysing the various judicial interpretations of the live-in relationships and disputes arising thereof.
