ABSTRACT

Criminal prosecution begins with a 'presumption of innocence,' and guilt must be shown beyond a reasonable doubt, according to common law and other nations. Using the Indian criminal justice system as a case study, this article will examine the many elements of fair trial standards and the role of defence lawyers in the pursuit of justice, as he is the only one in whom the lonesome accused may put his faith.
