A Comparative Analysis Of “Social Media” Platform For Speech And Expression In India And The USA

ABSTRACT


“Social media”, as we know, is the fastest means of communication in today’s time. The other thing is that its expression to a much wider audience. With such a tool of expression, also comes the need to be protected from any infringement of right that may happen due to such expression, along with the right of privacy which involves the data present in such form of expression.


In recent times, because the need or rather the will to use this platform has been tremendous, therefore the courts too have started including it in their ambit. There has been lots of development around them to ensure that the naïve are not exploited. Even the fundamental rights have been interpreted in ways to protect the rights of expression of “social media”.


The researcher is interested in conducting this research to analyse the interconnectedness of the right of privacy and social media for speech and expression and how fundamentally one cannot be enjoyed without the other in this realm. Also, a comparative analysis of how “social media” for speech and expression is given the freedom or the limitations of it is present in India and the USA.
